GMRA has had questions from a number of members who have received notices from Garden City Group, on behalf of Motors Liquidation Company counsel Weil Gotshal, requesting a vote for an amended plan of liquidation for unsecured claims, such as those filed by retirees.

Some of the claims for lost benefits (both health care and life insurance) are being objected to. There is a possibility that all of the claims could be objected to over time. The objections to the claims are based on the old GM not assuming responsibility for benefits and, although the new GM assumed the responsibility, both reserve the right to modify or terminate benefits under past court decisions. At this point, we are unaware of any claimants who have recovered or settled their claims.

We are reviewing the documentation and court actions that were sent to Motors Liquidation claimants with GMRA general counsel and may have additional information to share with GMRA members in the near future. If you are a claimant, we encourage you to consult with an attorney for legal advice.
